What Does The Kenyan Law Say About Treason?

According to the Merriam-Webster dictionary treason, in definition, is "the offense of attempting by overt acts to overthrow the government of the state to which the offender owes allegiance or to kill or personally injure the sovereign or the sovereign's family."

According to the Penal Code of the Laws of Kenya;

Chapter VII - Treason and Allied Offences
40. (1) Any person who, owing allegiance to the Republic, in Treason.
32 Cap. 63 Penal Code [2009]
Kenya or elsewhere -
(a) compasses, imagines, invents, devises or intends -

(i) the death, maiming or wounding, or the imprisonment or
restraint, of the President; or
(ii) the deposing by unlawful means of the President from
his position as President or from the style, honour and
name of Head of State and Commander-in-Chief of the
Armed Forces of the Republic of Kenya; or
(iii) the overthrow by unlawful means of the Government;
and
(b) expresses, utters or declares any such compassings,
imaginations, inventions, devices or intentions by publishing
any printing or writing or by any overt act or deed,
is guilty of the offence of treason.

(2) Any person who, owing allegiance to the Republic -
(a) levies war in Kenya against the Republic; or
(b) is adherent to the enemies of the Republic, or gives them
aid or comfort, in Kenya or elsewhere; or
(c) instigates whether in Kenya or elsewhere any person to
invade Kenya with an armed force,
is guilty of the offence of treason.

(3) Any person who is guilty of the offence of treason shall be
sentenced to death.

10,000 Kenyans Risk Joblessness As 35% Tax Hits Casinos


Owners and bosses of Kenyan casinos have raised a warning on massive losses and closures if authorities reject a reversal on the recent increase in taxes.
The industry generates annual revenues of about 2 billion shillings.

Analysts say that once the taxes are in force, it will not be possible to shoulder the burden. Several casinos have expressed their inability to absorb the new 35% tax.
Casinos were initially required to pay 12% in taxes and the players in the betting and gaming industries have tried to convince the government to reconsider the policy. The government has however insisted that they will continue with the plan. Deputy President William Ruto said that the tax rate is not negotiable and promised that the government will help fund deficits after giant bookmaker SportPesa withdrew sports sponsorship.

“We cannot pass on the 35 percent tax to consumers by changing our odds or increasing our income. If we are forced to cease operations, we will lose trained employees and pay terminal dues, making it very difficult to revive the industry at a later date," said an official.

He added that should casinos close up shop, the business will either go offshore or underground.

Telegram Was Removed From Apple's App Store. Here's Why


Apple removed Telegram’s official app from its iOS App Store a few hours after Telegram launched an updated Telegram X app for Android. Telegram X  was under testing on iOS, and it was also removed from the App Store. 
Telegram's CEO Pavel Durov tweeted, "We were alerted by Apple that inappropriate content was made available to our users and both apps were taken off the App Store."
“Once we have protections in place we expect the apps to be back on the App Store,” he added

While it is not specified when Telegram will return to the App Store, TechCrunch speculates that inappropriate content on the messaging service had no particular filters for objectionable material, mechanisms to report it, and the ability to block users from the service.
It’s possible that some content was making it through any filters in place.

Telegram definitely has porn. Furthermore, the removal could be related to the use of the app by terrorists and extremists as a possible cause for the removal. Apple’s guidelines do prohibit “upsetting or offensive content,” that encourages “illegal or reckless use of weapons and dangerous objects.” Another reason could be cryptocurrency scams that have risen in popularity by offering bogus initial coin offering (ICO) scams.

Miguna Arrested In Morning Raid. Is Raila Odinga Next?


After warnings that the government would crack on those involved in the swearing-in ceremony of Raila Odinga, the second individual in the triangle has been arrested.

After the arrest and later release of Ruaraka MP, TJ Kajwang, police today arrested Miguna Miguna and by the time this article was written, he was being held at Githunguri Police Station in Kiambu.
This leaves one more person that was core to the whole event.
The man who took the oath.
Judging by the public discourse on social media, most know that it is the riskiest move.
After self-proclaimed National Resistance Movement (NRM) general Miguna Miguna was arrested in the morning, riots broke out in sections of Kibra when supporters blocked roads to express their displeasure.
He had sent the message below to media houses.

Supporters who showed up at his house scuttled after police lobbed tear gas at them.
The police alluded to Miguna's earlier comments that NRM supporters should get rid of President Uhuru Kenyatta's pictures in their businesses as one of the reasons he was arrested. His participation in the 30 January oath ceremony was also another factor.
All this leaves one more point of the triangle.
Will the former prime minister be arrested or will that be an error that will disturb the hornets' nest?

***Update- Miguna Miguna has since been released on bail.
A crowd marooned Githunguri Station saying that he should not be released.
He was re-arrested and allegedly moved at night.

Sheila Mwanyigha Prezzo Fired Pictures Hot

Former television and radio presenter was one of the people who Nation Media Group fired and since then she has migrated from traditional media to the online platforms.
She has a YouTube channel called Sheila Lives Out Loud and has of late been vocal on social media, giving her two cents on matters she feels she is well versed with.
When three major media houses found themselves shut down for airing live the swearing in of Raila Odinga, an online debate ensued on the preparedness of the country to survive without the three media houses that advertisers almost wholly depend on.
Sheila Mwanyigha feels there is need for marketers to have a bigger budget on social media campaigns and the influencers.
Media shutdowns serve to emphasize the need for marketing budgets to invest in social media marketing and especially the influencer campaigns.

The lady also said we are living in unusual times in the country and painted a dark picture for the mainstream media saying they will be shut down over and over again and thus the need for us to think beyond them.

Milestone In Anti-Poaching Campaign As Hong Kong Bans Ivory Trade

It was a great day for elephants as lawmakers in Hong Kong voted overwhelmingly to ban ivory trade by 2021. This is in support of global efforts to save elephants from poachers who have been the major cause of high declines in elephant population.
This move has been highly received by animal activists, conservationists, environmentalists and animal loves who said that this ban effectively fixes a loophole in the fight against elephant poaching.
This move is coming after China banned the trade late last year.
Hong Kong is considered the largest market in the world for ivory, a market that has existed for more than 150 years.
This ban has thrown a much needed lifeline to elephants which were on the verge of extinction due to high death rates caused by poachers.
Kenya has led the global campaign against poaching by burning elephant tusks confiscated from poachers. The country, months back, torched the largest stockpile of elephant tusks in history and urged the world to join the campaign.

Currently, there are only 415 000 elephants in the world. Over the past decade, the number of elephants has reduced by more than 110 000.

Larry Madowo, Ken Mijungu Being Sought By Police In Swearing In Purge
A number of high ranking journalists in the country are in the police radar for undisclosed reasons in the wake of Raila Odinga's swearing in ceremony.
Linus Kaikai, NTV's general manager and Kenya Editors Guild chairman, received reliable information from officers in the directorate of criminal investigations that he was to be arrested today.
Human rights activists and Linus Kaikai's legal team gathered at Nation Center waiting for his arrest but that was not the case. The police officers did not show up.
While the director of criminal investigations Mr George Kinoti denied sending any police officers to arrest Linus Kaikai, security guards manning the Nation Center reported that they had spotted police officers around the building.
Sources say that Larry Madowo and Ken Mijungu, both journalists at Nation Media Group, are also part of the group the government plans to arrest.
Larry Madowo broke his silence on Twitter and said he was ready to be investigated by the government.

Controversial blogger Cyprian Nyakundi is under police custody after being arrested some time last night.
A close confidant of the self proclaimed boy-child defender has told Daily Updates that Cyprian Nyakundi spent the night at Kamukunji police station pending his presentation in court to answer to defamation charges.
Nyakundi had alluded in his online posts that Interior and National government co-ordination cabinet secretary Fred Matiang'i is involved in a love saga in his church.
Nyakundi had earlier on led a spirited social media campaign to have his relative released after they were allegedly arrested to mount pressure on him.
Nyakundi also claimed that his car had been destroyed and his 6th laptop confiscated by flying squad officers.

Exclusive: Assassination Attempt On The Life Of Kalonzo Musyoka

Former Vice President Kalonzo Musyoka has confirmed that gunshots were fired and a 
grenade detonated at his residence in what he has described as an assassination attempt on his life.
Kalonzo Musyoka spoke to Associated Press on phone and said the government had earlier blocked him from attending the swearing in of Raila Odinga where he was set to take oath too.
Kalonzo spoke of his misfortunes after the government withdrew his security in a bid to intimidate him. Kalonzo is entitled to state security by the virtue of being a former vice president.
After his security was withdrawn, he sought the services of a private security firm. He says the firms security vehicle which was parked outside his gate may have prevented the attackers from accessing the compound and causing more damage.
In the same interview, he says he has felt more vulnerable than ever before but did not expect the attacks to start so soon.

High Court Awards Dennis Itumbi Sh 5 Million For Illegal Arrest And Detention

Statehouse digital communications director Dennis Itumbi is smiling all the way to the bank after the high court awarded him Sh 5 million for illegal arrest and detention by the state over the alleged hacking of the ICC website.
The judgement delivered by Judge Joseph Onguto of the constitutional and human rights division gave him Sh 45 million less than he had sought.
Itumbi argued in court that his detention without trial had been influenced to his closeness to Uhuru Kenyatta who was at that time facing charges at the International Criminal Court.
The prosecutor of the court at that time, Louis Moreno Ocampo, claimed his email account had been hacked and that is when Itumbi's woes started.
Some Kenyans online were disappointed with the court's decision saying there are many people who deserve compensation from the government and it was misplaced for government to award those in government.

Media Houses Count Billions In Losses In The Aftermath Of Shutdown

The decision by the three evil big sisters to defy government's order not to air live the swearing in of Raila Odinga has had negative impacts they did not project.
The government made true its threat that it would shut down any media house airing the event. Citizen TV, NTV and KTN were all put off air when their transmitters in Limuru were shut down by the Communication Authority of Kenya.
No explanation has been produced by government on that decision and the media houses have said they do not understand the mistake they had made.
The shutdown meant billions in losses of advertisement revenue as the television stations were off all day.
Many have projected that the media houses will move to court to seek compensation. Many lawyers have also advised them so.

Bomb squad officers and experts have been deployed to former vice president's residence after a grenade like device was hurled at the compound by unknown people.
The early morning incident which occurred at 2 am Wednesday also had shots fired as unknown people in two vehicles drove into the compound and opened fire.
A guard who was manning the compound has confirmed this happening. No one has been reported injured and the whereabouts of Kalonzo Musyoka not talked about.
Karen OCPD Cunningham Suiyanka said that a grenade like device has been discovered in the compound and their officers are investigating.
Kalonzo Musyoka's security detail has been withdrawn by the government and the officers who were protecting him were disarmed and ordered to report back to their units.
Kalonzo failed to turn up for his swearing in and cited circumstances beyond him as the reason for his no show.

Government Declares National Resistance Movement An Organized Criminal Group

In a special gazette notice dated 30th January 2018, government through Cabinet Secretary for Interior Fred Matiang'i has placed Raila's National Resistance Movement in the same category as al Shabaab, Mungiki, MRC, Chinkororo among others.
In exercise of the powers conferred by section 22 of the prevention of organized crimes act 2010, the cabinet secretary, ministry of interior and co-ordination of national government declares National Resistance Movement(NRM) to be organized criminal group for the purposes of the Act.

Consequently, NRM which has been agitating for electoral reforms in the country is illegal and its activities outlawed.
This has been widely seen as a move to clip the wings of Raila Odinga who has just sworn himself in as the people's president of the Republic of Kenya.
National Resistance Movement is now in the same list with Al Shabaab, Chinkororo, Kosovo Boys, Makande Army, Mungiki, Amachuma, Angola Msumbiji, Banyamulenge, Baghdad Boys, Charo Shutu, Coast Housing Land Network, Congo By Force, Dallas Muslim Youth, Forty Brothers, Forty Twi Brothers, Jeshi La Embakasi, Jeshi La Mzee, Jeshi La King'ole, Japo Group, Kamzesh, Mombasa Republican Congress among many others.

Political analyst Mutahi Ngunyi has reiterated claims he made in  April that NASA was hellbent on betraying the country.
Mutahi Ngunyi said on Twitter that Uhuru Kenyatta had no option but to charge Raila with taking an illegal oath under section 61 of the penal code.
We predicted the NASA betrayal in June 2017. Now Uhuru must charge Raila with taking an illegal oath under section 61 of the penal code. Zero option.
He also said that Raila had not been betrayed but had participated in a political assassination.
