What we know about those killed and injured

Barcelona
13 people are confirmed to have died after a van was driven into pedestrians in Las Ramblas.
Around 100 people were injured, at least 15 of them seriously.
Two men have been arrested – including Driss Oukabir, who was initially suspected of being the driver – but police have now said neither man was behind the wheel. They remain in custody.

Cambrils
Police shot dead four suspects in the coastal town, around 120kms from Barcelona. A fifth, who was injured and arrested, has since died.
Six bystanders were wounded, one critically and another seriously, in what authorities said was a possible terror attack. Reports suggested a vehicle was driven at pedestrians in an echo of the Barcelona attack, but this has not been confirmed.
A police officer was also lightly injured in the counter-terror operation.
Eyewitness accounts from Cambrils report “many gunshots” as police killed five people who had used a car to mow down pedestrians.
Markel Artabe, a 20-year-old restaurant worker, said he was on the promenade and saw someone lying on the ground “with a gunshot in the head”.
Joan Marc Serra Salinas, a 21-year-old waiter, said he heard gunshots “and shouting. And more shouting. I jumped on to the beach and didn’t move.”
Alcanar
One person was killed and at least one other wounded in an explosion that destroyed a house in Alcanar, around 200km from Barcelona and 90km from Cambrils,
The cause was initially thought to be a gas leak but police now say they are linking it to the attacks in Barcelona and Cambrils.
The health department has said that one of the six bystanders injured in Cambrils is in a critical condition.
Spanish media including El País are reporting that a group of assailants in the town ran over several people in an echo of the day’s earlier attack in Barcelona. This has not been confirmed by authorities. However, police have said that six civilians and one police officer were injured.The Catalan regional government has now said that citizens from 24 countries were among the people killed and injured during the Barcelona van attack.
That’s in addition to the four suspects shot dead and one arrested.
Isis has claimed responsibility for the attack in Las Ramblas, but this could not be verified.

You are in a cafe and an attractive woman makes eye contact with you. Instead of smiling back, you quickly look away worrying that you will offend her by staring or that you will creep her out. Earlier today, during the requiem mass of former IEBC ICT manager, Chris Msando, his widow gave a bitter eulogy. Chris Msando went missing and was later found murdered in a thicket in Kikuyu, Kiambu County.

The mass was held at the Consolata Shrine in Nairobi and most of the deceased's colleagues from the Independent Electoral and Boundaries Commission (IEBC) were present.

'I do not know where to start. I only have to ask why? Why? Why?' she began.

In her words, she described Mr. Msando as a charming man who was good at making friends and convincing people.

Ms. Eva Elsa Auma Buyu shared how her late husband had witnessed the birth of all their children and of the love they shared for 12 years.

In a moment of sorrow, she demanded that his killers be brought to justice by the government.

'Are you happy? Because I know you are watching! May you[the killers] not have peace. And vengeance is of the Lord. Na Mungu atatupigania. Wakenya tusimame imara. Chris's death will not go in vain. Tumekataa.'

She added that her late husband now saw that everybody voted seamlessly and nobody voted manually during the just concluded General Election.
She also painfully noted how wrong his murder was. 'Look at the babies..my oldest is 10.'

She led the congregation in singing a verse of the national anthem, 'Justice be our shield and defender.'
Eva also sang the hymn, 'In the sweet by and by' and said that she will once again meet her husband.

Immediately after his death, the government had promised to bring to account those involved. Investigative help was even offered from the FBI and England's Scotland Yard. It is unclear how far the investigations have reached.

All You Need To Know About The Supreme Court Of Kenya

The Supreme Court of Kenya is established under Article 163 of the Constitution as the final arbiter and interpreter of the Constitution. The Court comprises of the Chief Justice, who is the President of the Court, the Deputy Chief Justice, who is the Vice-President of the Court and five other Judges.
The Court has the exclusive original jurisdiction to hear and determine disputes relating to the elections to the office of President arising under Article 140 of the Constitution. 
(1) A person may file a petition in the Supreme Court to challenge the election of the President-elect within seven days after the date of the declaration of the results of the presidential election. 
(2) Within fourteen days after the filing of a petition under clause (1), the Supreme Court shall hear and determine the petition and its decision shall be final. 
(3) If the Supreme Court determines the election of the President- elect to be invalid, a fresh election shall be held within sixty days after the determination.
The Court also has appellate jurisdiction to hear and determine appeals from the Court of Appeal and any other court or tribunal as prescribed by national legislation.
However appeals can only be; 
As a matter of right where the case involves interpretation or application of the Constitution or a matter certified by the Supreme Court or the Court of Appeal as one that involves a matter of general public importance. The Supreme Court may review a certification by the Court of Appeal and either affirm, vary or overturn it.
 The Court can also render an advisory opinion at the request of the National Government, any State organ, or any County Government with respect to any matter concerning County Government. It can also determine the validity of a declaration of a state of emergency; an extension of such a declaration or any legislation enacted or action taken in consequence of a declaration of a state of emergency.
In 2013, the Supreme Court of Kenya arbitrated over its first ever Presidential petition where several parties challenged the election of President Uhuru Kenyatta and his deputy, William Ruto.
The case was decided unanimously by the six sitting judges that:

  • The elections were indeed conducted in compliance with the Constitution and the law.
  • That Uhuru Kenyatta and William Ruto were validly elected
  • That rejected votes ought not to have been included in calculating the final tallies in favor of each presidential candidate.
The final judgment was issued on 16 April 2013.
The court ruled that all members were to pay for their own costs.
After their announcement that they will present their case to the Supreme Court, this year's presidential petition will be determined by the following bench of judges;

In a surprising twist, NASA Coalition led by Raila Odinga today announced that they will go to the Supreme Court to challenge the results of the just concluded Kenyan elections. In an address to the media and the nation at the Okoa Secretariat in Lavington, the opposition leader said that the Supreme Court will have a chance to 'redeem itself'.'

In 2013, after the general elections, Kenyans were treated to a variety of jargon and legalese such as 'amicus curiae' and watched as great legal minds battled to present their cases.
In the announcement today, NASA said that they have enough evidence to prove that the Jubilee Party rigged the election and resulted in a fraudulent election and computer generated leaders.
The statement, read by Mr. Odinga, said that they had come to the decision after the attacks to civil society and Kenya Human Rights Commission and AfriCOG. Although they had earlier said they would not go to court, today's statement is different.

Furthermore, we act on behalf of those who have been blocked from seeking redress in courts such as the sustained clampdown on the civil society that have attempted to go to court. NASA wants to show the world what transpired in the fraud. Even as we go to Court, we are cognizant of the fact that ever since Uhuru Kenyatta and William Ruto publicly warned the Judiciary, the IEBC has not lost a single case in court. We have decided to move to the Supreme Court despite the history and other recent circumstances. In similar circumstances in 2013, we moved to the Supreme Court to challenge the declaration by IEBC of Uhuru as President-elect. The manner in which the Court handled that petition was a travesty of justice. The Court decided all interim applications in favour of Kenyatta. The Court also allowed the counter petition filed in favour of Kenyatta but disallowed the two petitions against him. Uhuru won 100 per cent and we lost 100 per cent in court. Our decision to go to court constitutes a second chance for the Supreme Court. The Court can use this chance to redeem itself, or, like in 2013, it can compound the problems we face as a country. We will show how they shamelessly cooked results from non-existent polling stations and fake un-gazetted Presiding and Returning officers. They gave figures from non-existent Forms 34A and 34B; they scrambled to manufacture such forms; switched vote numbers; and how they openly swindled to reach predetermined consistent vote numbers. They cooked numbers to the extent that vote tallies often surpassed registered voters in polling stations. Kenya is always much larger than my individual ambition. But Kenya is definitely not too large for all of us to ensure that anyone who wins the people’s votes, and not the loser, is declared President. This is just the beginning. We will not accept and move on.

Many had advised the coalition to go to court if they had any evidence to prove that the elections were rigged. While Senior Counsel and other lawyers pocket millions from the case, it will remain to be seen who will carry the day. From previous cases, it is very likely that Senior Counsel Fred Ngatia will be part of the Jubilee legal team.

Veteran Politician Kenneth Matiba Awarded Sh 504 Million Over Torture By State

The High Court today ruled that veteran politician Kenneth Matiba will be awarded compensation for the one year period he served in detention during President Daniel Moi era. Mr. Matiba was awarded Sh 504 million in damages.



Mr. Matiba referred to as Kenya's second liberation hero sued the State in 2014 seeking Sh9.1 million compensation for the suffering he underwent following his imprisonment. He asked for Sh9,153,103 for medical expenses, general, exemplary and aggravated damages following his unlawful arrest, imprisonment and stroke which he suffered.
Mr. Matiba was arrested on July 4, 1990, four days ahead of the Saba Saba rally he had organized and taken to Lang’ata Police Station. He was released on  June 4, 1991, after a head scan showed that he was bleeding in the brain and required urgent blockage of the arteries
But according to the Attorney General, who has been sued in the case, Mr Matiba was not mistreated while in custody.
The case was heard by Supreme Court Judge Isaac Lenaola and the judgment was delivered on his behalf by High Court's Justice Enoch Chacha Mwita.

After the brutal murder of former IEBC ICT Chief, Chris Msando, various allegations have been made over who the killers were and their intention.
NASA leader, Raila Odinga today went to visit the family of the late to grieve with them after the injustice that happened just before the Kenyan general elections.

We Will Address The Nation Tomorrow, Says NASA

In a press release to news rooms this afternoon, the opposition coalition NASA have postponed the address that was to be made today by Raila Odinga.

The country had started to go back to normal activities but there was anxiety on the announcement to be made.
The statement comes after increasing calls for peace and announcements for them to concede and accept the results.
The statement, signed by Musalia Mudavadi read as below;
Owing to the urgency, complexity and delicate nature of issues Nasa Summit is handling, our consultations are ongoing and progressing well,
We regret that the consultations are taking longer than anticipated and Nasa will therefore not address Kenyans as projected today. Nasa will issue a comprehensive statement to the nation tomorrow.

County Transition: How New Governors Shall Be Sworn In

In an announcement by the Cabinet Secretary, Mwangi Kiunjuri, the newly elected governors will be sworn in starting this Thursday, 17 August.
Mombasa governor-elect Hassan Joho will be sworn in by Justice Weldon Korir and Magistrate Evans Maker on Tuesday 22.The event will be held at the Mama Ngina drive, Mombasa
As at the time we went to press, 47 Judges and Magistrates have been appointed to preside over the swearing in ceremonies scheduled at each county.
On Tuesday 15 August, Devolution CS Mwangi Kiunjuri said the events have been organized by each county's Assumption of the Office of Governor Committee.The committees were established on July 8.
"According to Gazette Notice No. 6409, governors shall be sworn in 10 days after the declaration of election results," the CS said.
Lee Kinyanjui, the new Nakuru governor-elect, will be sworn in on Monday at the Afraha Stadium.
The event will be presided over by Justice Justus Bwonwonga and Magistrate Godfrey Oduor.
Nairobi Governor-elect Mike Sonko will be sworn into office by Justice David Majanja and Magistrate Paul Mulwa at the Uhuru Park grounds next Monday.
Kisumu Governor-elect Anyang’ Nyong’o will be sworn in by Justice Dora Chepkwony and Magistrate Julius Ng’ang’a. The event will be held at the Jomo Kenyatta sports ground, Kisumu next Monday.
In Kwale, the event to swear in Governor-elect Salim Mvurya will be held at Kwale Baraza Park on Monday 21.
Kilifi Governor-elect Amason Kingi's swearing in ceremony will be at Larisa Maitha gardens also on Monday 21.
The new county bosses are required to be sworn in not earlier than 9 am and not later than 5 pm.
Kiunjuri also said outgoing governors will receive send-off packages as per the law.

LATEST: Ekuru Aukot Says IEBC Results Went 'Fundamentally Wrong'

In an unexpected turn of events, Kenyan presidential candidate Ekuru Aukot posted on his twitter handle that his party's auditing of the results transmission revealed a worrying trend. He further added that something went 'fundamentally wrong'.

A few days ago, Mr. Aukot had a press briefing to concede defeat and congratulate president elect Uhuru Kenyatta. He added that Raila Odinga had done his part in the development of multiparty democracy in Kenya.

However, the presidential candidate who garnered 27,385 votes on Tuesday 15 August posted the following tweet on his Twitter handle:

It Was Never About Me. I Will Never Run For President Again, Says Raila

In an interview with the Financial Times at his home in Nairobi, NASA Chief, Raila Odinga said that he will never run for president again. After a bitterly contested election, this statement leaves people guessing on what his next move will be.

During the interview, Odinga said that he was not trying to get power through any means that is not enshrined in the Constitution. He reiterated that this was not for him but to help the people of Kenya. He added that his intention was to show to the world the gross injustices that have been meted to the Kenya people.

He said that the world does not understand what is happening.

When international observers said that the election was free, fair and credible, Mr. Odinga expressed his disappointment. He said that he will prove how the process was interfered with in favor of his opponent, Uhuru Kenyatta.

He told the Financial Times that if elections in a democracy were to be held this way, then there was no need for voters to queue for many hours yet their vote would not count.

After the death of IEBC IT Manager, Chris Msando, the officials of the electoral body had no option but to play 'under metaphorical gunpoint', he added.

In an address to his supporters after a long silence, he urged them to be calm and not go to work to mark a mourning period for the deaths of their compatriots who had lost their lives to the post election violence that followed the declaration of Mr. Uhuru Kenyatta as the winner.

However, he said that he will make a major announcement on Tuesday, 15 August 2017.




The Real Suspense In Kenya: Scathing Article About Raila Odinga

Many have labeled him a statesman and many love him beyond anything. On the other side, many hate him and even more do not wish him well. However, logic says that the man has made a huge contribution to the multi party democracy that Kenya now enjoys.

After the victory of Uhuru Kenyatta and the Jubilee Party, the country remains divided on who is telling the truth. Raila Odinga has now run for the top seat, three times in a row without success.
After various international observers gave the elections a clean bill of health, Mr. Odinga came out to say that he was disappointed in them.

Moreover, his party's persistent claim that the election was rigged might have rubbed others the wrong way.

In an article penned by the editorial board of The New York Times on August 13, 2017, the author referred to Mr. Odinga as a perennial loser who refused to accept his defeat in 2007, 2013 and recently in 2017.
The article further claims that Odinga's comments of fraud have sparked violence among his supporters in the country and this could spread.

Both President Kenyatta and Mr. Odinga, a Luo, come from families and networks that have dominated Kenyan politics since independence, and both represent coalitions of ethnic groups. Mr. Odinga has once again fanned the embers of ethnic strife.

The tone in the article show unhappiness in the decision of the opposition chief to reject the election results. Much of the doubt is brought about by the claims that they have not presented enough evidence.
After speaking to his supporters, Odinga promised to speak again on Tuesday, 14 August to clear the air and announce the way forward for his supporters.

Even though many might have declared his political career as good as over, he has repeatedly proven critics wrong.

This time the whole world waits to hear from the man.

Questions Raised Over Missing NASA Coalition Principals

In their final rally at the Uhuru Park in NAIROBI, the five principals of the NASA Coalition addressed their supporters promising a new government and showed their solidarity in the quest to win the elections.
However, ever since the IEBC declared the incumbent president, Uhuru Kenyatta as President elect in the hotly disputed elections, questions arose over their unity.

Ever since the opposition came out to claim the election was a 'fraud' and then reject the results, the address to the media has been questioned by various people and citizens.

Musalia Mudavadi and James Orengo were the most vocal at first before the electoral body declared Mr. Kenyatta as the winner of the election. Since then, several ODM leaders have addressed the press, including James Orengo, Johnstone Muthama, Millie Odhiambo and even Babu Owino.

On Sunday 13 August, in their rallies in Kibera and Mathare, notable absentees were Kalonzo Musyoka, Moses Wetangula, and Isaac Ruto.

Especially curious, is the absence of former Bomet governor, Isaac Ruto who has not addressed the press ever since he lost the seat to outgoing deputy national Assembly Speaker Joyce Laboso.
After his announcement that the NASA Coalition will make a major announcement on Tuesday, 15 August, it will be interesting to note if the other principals will be seen in the public.

Relative calm has returned to major towns in Kenya as citizens return to work.

Opposition Leader Raila Odinga Declares Monday, 14 August A National Holiday!

In a startling declaration after a day of silence, Kenyan opposition leader, Raila Odinga shocked many when he declared Monday 14 August a holiday and asked his supporters not to go to work. Speaking to a charged mammoth crowd in Mathare and Kibra, Raila said that due to the massive vote rigging that occurred in the recent election and the deaths of civilians that followed, the day should be observed as a day of mourning.

Since Friday, Mr. Odinga has been silent and it is only Musalia Mudavadi and James Orengo who have been speaking to the press. However, in a surprising turn of events, the NASA Coalition announced that the leader would go to address his supporters in Kibra then visit the family of the 9-year-old girl who was killed during the riots in Mathare.

The veteran opposition leader greeted the crowd then asked them not to go to work to mourn the death of the little girl. Speaking in the company of several ODM legislators, the leaders reiterated that they would not accept the result of the election. In an ironic statement, Senator James Orengo asked the crowd not to buy Daily Nation newspapers or watch NTV, which is a sister television station. He said that the media has been silent over the brutal killings by police and they should not receive support. At that moment, NTV was the only Kenyan station broadcasting the speech. They stopped the live broadcast a few minutes later.

A few minutes later, the excited crowd started chanting that 'Uhuru Must Go' and soon broke out into a song to say that the party leader has never killed anyone.

Earlier, we wrote an article on the impasse that is in the current political arena. Although Uhuru Kenyatta was declared as duly elected President-elect, the opposition denied recognizing these results.

According to the Kenyan Constitution, only the government through the Interior Ministry or the President can declare a public holiday. Mr. Odinga is gutsy to dare ask his supporters to stay away from work and it will remain to be seen how this will affect the economy.

Most of the residents of Kibra and Mathare are low-income individuals who have no jobs or live under a dollar a day.


British Soldier Dies In Nanyuki In Mysterious Circumstances

In a mysterious incident in Nanyuki town, a British soldier attached to the town's British Army base died in his girlfriend's house.
It is reported that the soldier visited the woman for normal interaction when he complained of a headache shortly before his death.

Residents of the area rushed to the area to witness the incident and police had to shoot in the air to disperse the crowd.

Since then, tension has been high in Nanyuki town after David Jones, who is said to have been in his 30s, visited the woman, Joyce Nyakinyua's house on Saturday, August 12 evening.

Laikipia East police boss James Kithuka said  that the soldier told the longtime girlfriend that he had a severe headache before vomiting. He later collapsed and died.

Rumors indicate that the soldier might have died after taking sex enhancement drugs.

A British Army ambulance picked up Jones' body and took it to Nairobi for postmortem.

In recent years, British soldiers training in the counties of Samburu and Laikipia have been involved in scandalous affairs with local women.

A senior official at the camp in Nanyuki town said soldiers are now allowed to engage with women in their houses as it is considered gross misconduct to bring them into the Army base.

What Next For Kenya? Election 2017 Impasse

Since Tuesday, 8 August after a very peaceful election, Kenya has been tense. Emotions run high because of the unpredictable events that usually accompany vote tallying and winner announcement.
According to the electronic tallying system and the portal availed to the nation, the incumbent president, Uhuru Kenyatta led the vote from start to finish.

However, before Kenyatta was even formally declared winner, the opposition coalition, led by Raila Odinga rejected the vote tallying. This was a shocker as it only compared to the 2007 elections that were marred by deadly post election violence. The opposition presented their evidence of claimed hacking that was rejected by the Independent Electoral and Boundaries Commission.

Ideally, everyone expected that the opposition would now prepare a strong case to present to the Supreme Court as they did in 2013. However, this has not happened and each time they appear to address their supporters, they reiterate that they will not accept the sham results.

After the sparks of violence that have rocked various parts of the country, there is still a feeling that this is far from over. Although international electoral observers endorsed the re-election of President Kenyatta, the opposition still refuse to accept the results.

This has resulted in a somewhat divided nation with supporters sticking to the words of whichever candidate they voted for. What unsettles many are the comments made by a leader in the NASA Coalition, Senator James Orengo. Mr. Orengo categorically stated that they would not be going to court to settle the impasse. In addition to this, opposition leader Raila Odinga has gone quiet and this creates more tension and unpredictability. According to a source, the opposition say that this is a political issue that can only have a political solution. Although unclear, we can be certain that this is far from over.

Only time will tell what will happen next. As life seems to go back normal, we await the next move by the NASA Coalition because their remarks will probably decide how this will end.
