No Can't Do. High Court Stops Mass Head Teacher Transfers

After an uproar over the mass transfer of headteachers initiated by the Teacher Service Commision, the High Court has come to the rescue.
The massive transfer had already affected 31 principals of national schools who were moved to new institutions.
The High Court sitting in Kisumu has stopped the Teachers Service Commission (TSC) from effecting the transfers of secondary school teachers across the country.

The order was issued by Justice David Majanja in the case that the TSC and Education Cabinet Secretary Fred Matiang’i had been sued.

“Leave granted do operate as a stay to the directive to TSC to effect a mass transfer of secondary school principals across the country,” said Justice Majanja.

During the last week , the employer transferred a total of 557 head teachers of secondary and primary schools.

A total of over 130 vacant positions at the county schools have also been filled in the transfer exercise while 19 heads were moved at the technical institutions.

Update>>>The case has since been referred to the Labour Relations Court. The High Court says it has no jurisdiction.
